Removing complexity from government Tenders

Print media are awash with articles about the many factors that can and do go wrong with the tenders process, or the pending changes to the process itself.

The amendments proposed by the Department of Trade and Industry (DTI) to the Preferential Procurement Policy Framework Act (PPPFA), a pillar of public sector procurement in South Africa, have featured extensively.

It is a complex issue, especially because the changes being put forward are owed to the Broad-Based Black Economic Empowerment (BBBEE) Strategy which the DTI implemented to better manage the overall transformation of the economy in relation to all the different BEE charters and sector policy guidelines that confuse more than they clarify.

“The solution to all this is getting back to the basics,” says Bernie van Niekerk, editor of SmartProcurement.

When dealing with many different Laws and regulations that apply differently to the many divergent branches and organs of government, you run the risk of confusing personnel and managers, says Van Niekerk.

With this in mind SmartProcurement has teamed up with an expert in public sector procurement to focus delegates on the fundamental legal issues, the basic procedures and best practises to apply when managing any tender, regardless of whether it is conducted by a government or provincial department, by a metro or district municipality or by one of the 256 state-owned enterprises.

Delegates will be taken through the A to Z of government tendering to cover the essentials of:

• Government’s present supply chain management and procurement policy and the legal and regulatory framework.
• Demand management and the direct application of the PPPFA and BEE acts and regulations and the role of the Bid Specification Committees.
• Acquisition management, which deals with the very important roles of the Bid Evaluation and Bid Adjudication Committees.

In addition to the detailed manual on ‘Managing Tenders’, each delegate will receive a bound file on the ‘Legal Aspects of Tenders in South Africa’.
